This means that your Domain-Name has sent too many emails in (1)One Hour to emails that are not working or does not exsist.

The server will block all outgoing mail from your Domain-Name for (1)One Hour and only provide you with this error when sending any new mail within that same hour:

Error:
Domain XYZ.co.za has exceeded the max defers and failures per hour (15/15 (15%)) allowed. Message discarded.

It would help if you stopped sending emails to email addresses that do not exist or do not work, unfortunately, the server sees your email marketing or sending of emails to broken or non-existing emails as Spam.

Email servers care about failed messages and deferred messages, the more you send to failed emails the more you get reported by the email servers or admin. In Turn, this will add you to an International Blacklist and now your Domain will be able to send emails but no one will get them, as it will be blocked, until a formal request and promise, never to send spam again and proof of actions taken to prevent it in future, is made, they will not remove your Domain-Name  from this BLACK-List and this process can take a few days to work through with their support team.

This should make it clear to you, why we set the server not to allow you to send too many failed or deferred emails, as this will prevent your Domain-Name from being Black-Listed by the international blacklists. 

Sending Spam is NOT legal! Email Marketing is a nice word for Spam.
Please see your own country's laws about sending Spam or unlisted emails or marketing emails.


Here is the POPiA Law in South Africa as an Example:

In South Africa, sending spam is illegal under the Protection of Personal Information Act (POPIA).
This law aims to protect personal information and regulate how organizations handle it.

Section 69 of POPIA specifically addresses unsolicited electronic communications for direct marketing.
According to this section, it is an offence to send such communications unless the recipient has given explicit consent (opt-in) or is an existing customer who has not opted out.

 Violating this law can result in fines up to R10 million or imprisonment for up to 10 years, or both.

South African law

There are several pieces of legislation which deal with spam, including:

  • Section 45 of the Electronic Communications and Transactions Act, 2002 (No. 25 of 2002)
  • Section 11 of the Consumer Protection Act, 2008 (No. 68 of 2008)
  • Section 69 of the Protection of Personal Information Act, 2013 (No. 4 of 2013) (“POPIA”)

 

The goal is to prevent spam from becoming a nuisance and to protect individuals from potential fraud and privacy breaches.
